At EnergyMo, your privacy is fundamental to everything we build. This Privacy Policy explains how EnergyMo Inc. ("EnergyMo", "we", "us", or "our") collects, uses, discloses, and protects your personal information when you use our products, services, website (energymo.ai), and mobile applications.

EnergyMo Inc. ("EnergyMo", "we", "us", or "our") respects your privacy and is committed to protecting the personal data you share with us. This Privacy Policy describes the types of information we collect from and about you when you visit our website (energymo.ai), use our mobile applications, purchase our products, or interact with our services. By using any EnergyMo product or service, you acknowledge that you have read and understood this Privacy Policy.

2. Information We Collect

We collect several categories of information to provide and improve our services:

  • Personal InformationName, email address, phone number, shipping and billing addresses, date of birth, and payment information that you provide when creating an account, making a purchase, or contacting support.
  • Health & Biometric DataHeart rate, heart rate variability (HRV), blood oxygen saturation (SpO2), skin temperature, sleep stages and duration, activity metrics (steps, calories, distance), stress levels, and menstrual cycle data collected through your EnergyMo Ring.
  • Device & Technical DataRing model and firmware version, smartphone model and OS version, Bluetooth connection data, IP address, browser type, device identifiers, crash logs, and diagnostic data.
  • Usage DataApp feature usage patterns, session duration, pages visited on our website, search queries, interaction with notifications, and in-app preferences and settings.
  • Purchase & Transaction DataOrder history, payment method details (processed by our secure payment partners), shipping preferences, return and exchange history, membership subscription status, and billing records.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Providing Our ServicesTo operate the EnergyMo Ring, deliver personalized health insights and recommendations, process your orders, manage your membership, and provide customer support.
  • Health Insights & PersonalizationTo generate your daily readiness scores, sleep analysis, activity summaries, stress assessments, and trend analysis. Your health data powers the personalized recommendations and alerts you receive.
  • Processing TransactionsTo process purchases, manage subscriptions, handle returns and exchanges, send order confirmations and shipping updates, and maintain billing records.
  • CommunicationTo send you important product updates, firmware notifications, membership information, and marketing communications (with your consent). You may opt out of promotional emails at any time.
  • Research & ImprovementTo improve our algorithms, develop new features, conduct aggregate health research (using de-identified data only), and enhance the accuracy of our sensors and health metrics.
  • Legal & SafetyTo comply with legal obligations, enforce our terms of service, prevent fraud, protect the security of our users and systems, and respond to lawful requests from public authorities.

4. How We Share Your Information

We do not sell your personal data. We may share your information only in the following limited circumstances:

  • Service ProvidersWe share data with trusted third-party providers who assist us in operating our services, including payment processors (e.g., Stripe), shipping carriers, cloud hosting providers (e.g., AWS), email delivery services, and customer support platforms. These providers are contractually bound to protect your data.
  • Health Platform IntegrationsWhen you explicitly connect your EnergyMo account with third-party health platforms (such as Apple Health, Google Fit, or Strava), we share the specific data you authorize. You control these connections and can revoke access at any time.
  • Legal RequirementsWe may disclose your information when required by law, in response to valid legal processes (such as a court order or subpoena), to protect the rights, property, or safety of EnergyMo, our users, or the public.
  • Business TransfersIn the event of a merger, acquisition, reorganization, or sale of assets, your personal information may be transferred. We will notify you before your data becomes subject to a different privacy policy.

5. Data Security

We implement industry-leading security measures to protect your data. All health data is encrypted using AES-256 encryption both in transit (TLS 1.3) and at rest. We maintain SOC 2 Type II compliance and conduct regular third-party security audits and penetration testing. Access to personal data is restricted to authorized personnel on a need-to-know basis with multi-factor authentication. We use secure, dedicated infrastructure for health data storage with geographic redundancy. In the unlikely event of a data breach, we will notify affected users and relevant authorities as required by applicable law within 72 hours.

6. Data Retention

We retain your personal data only as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Account data is retained while your account is active and for up to 30 days after deletion request. Health data collected by your ring is retained for the duration of your active membership. Transaction and billing records are retained for 7 years as required by tax and financial regulations. After the applicable retention period, your data is securely deleted or anonymized.

7. Your Rights & Choices

Depending on your jurisdiction, you may have the following rights regarding your personal data:

  • Right to AccessYou can request a copy of the personal data we hold about you. In the EnergyMo App, go to Settings > Privacy > Download My Data to export your data at any time.
  • Right to RectificationYou can update or correct inaccurate personal data through your account settings or by contacting our support team.
  • Right to ErasureYou can request deletion of your personal data. Go to Settings > Account > Delete Account, or email [email protected]. Note that some data may be retained as required by law.
  • Right to Data PortabilityYou can export your health data in standard formats (JSON, CSV) for transfer to other services or for your personal records.
  • Right to RestrictionYou can request that we limit the processing of your personal data under certain circumstances, such as when you contest the accuracy of the data.
  • Right to ObjectYou can object to the processing of your personal data for direct marketing purposes. You can also object to processing based on legitimate interests where your rights override our interests.

8. Children's Privacy

EnergyMo products and services are not intended for children under the age of 16. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at [email protected]. If we learn that we have collected personal information from a child under 16, we will take steps to delete that information promptly.

9. International Data Transfers

EnergyMo operates globally, and your data may be transferred to and processed in countries other than your country of residence. We ensure appropriate safeguards are in place for international transfers, including Standard Contractual Clauses (SCCs) approved by the European Commission, adequacy decisions where applicable, and compliance with the EU-U.S. Data Privacy Framework. Regardless of where your data is processed, we apply the same level of protection described in this Privacy Policy.

10. Third-Party Links & Services

Our website and app may contain links to third-party websites, services, or integrations that are not operated by EnergyMo. We are not responsible for the privacy practices of these third parties. We encourage you to read the privacy policies of any third-party service you interact with. Our use of third-party analytics tools (such as Google Analytics) is governed by their respective privacy policies, and we configure these tools to minimize data collection wherever possible.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will notify you by email (using the address associated with your account), through the EnergyMo App, or by posting a prominent notice on our website at least 30 days before the changes take effect. Your continued use of our products and services after the effective date constitutes your acceptance of the updated policy.
